Infringement Policy

At Borniyo, we are dedicated to removing infringing products from our platform to maintain Buyer trust and ensure a positive shopping experience. We have established the Borniyo Infringement Verification process to make it easy for intellectual property owners to report listings that infringe their rights. Our goal is to swiftly address and remove infringing products to protect our Buyers and uphold the integrity of our platform.

Policy

Borniyo respects third-party Intellectual Property (IP) rights and actively supports the protection of all third-party IP, including Copyrights and Trademarks. We respond promptly to clear notices of alleged IP infringement.

When we receive proper notification of IP infringement, we will respond by removing or disabling access to the material claimed to be infringing.

How to Report a Listing

If you believe in good faith that your IP rights have been infringed on our platform, you can follow the process outlined below. We require the Intellectual Property right owner or authorized agent to provide the following details and email them to our legal partner Btech Marketing Wala at infringement@btechmarketingwala.com. Your email should contain the following information:

1. Identification or description of the copyrighted work/trademark that has been infringed.
2. Clear identification or description of where the material that you claim is infringing is located on the App with adequate particulars. Include the Product ID/Link of infringing products (in case of copyright infringement).
3. Your address, telephone number, and email address.
4. A statement by you that you have a good faith belief that the use of the material complained of is not authorized by the copyright or intellectual property owner, its agent, or the law.
5. A statement by you that the information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.
6. Brand Name (in case of Trademark infringement).
7. Details of the intellectual property being infringed (Provide copyrighted images or trademark certificates as attachments).

Borniyo Response to Infringement Verification Notifications

Upon receiving a proper notice with the requisite documents, Borniyo will act promptly to remove or disable the alleged infringing content. Borniyo retains the right to take appropriate actions according to the applicable laws at the time of notification. Previous removals or disablings do not prevent us from taking actions contrary to earlier decisions.
